A renewed focus on allergen management across Australian hospitality is a practical reminder that food safety is not only a compliance issue.
For restaurants, cafés and takeaway venues, it can also become a serious insurance issue if a customer suffers an allergic reaction after relying on menu information, staff advice or preparation practices.

Recent hospitality industry attention has centred on the difficulty of managing allergens in busy venues, particularly where menus change frequently, suppliers substitute ingredients, or front-of-house teams are expected to answer detailed dietary questions during peak service. Even well-run businesses can be exposed if communication between the kitchen, suppliers and service staff breaks down.

From an insurance perspective, the key concern is liability. A serious allergic reaction may trigger allegations that a venue failed to provide accurate information, failed to prevent cross-contamination, or did not train staff adequately. That is where public liability and product liability cover become important parts of a restaurant insurance programme, although each policy will still depend on its wording, exclusions, limits and claims conditions.

Restaurant owners should also think beyond the policy schedule. Insurers and claims assessors often look for evidence that the business had practical systems in place before the incident. This may include written allergen procedures, supplier records, staff training logs, menu version controls, incident reports and cleaning protocols. If those records are missing, incomplete or inconsistent, it can make an already stressful claim more difficult to manage.

There are several practical steps venues can take to reduce the risk:

  • Keep an up-to-date allergen matrix for all menu items, including specials and seasonal dishes.
  • Train front-of-house staff to avoid guessing and to refer uncertain questions to a manager or chef.
  • Document supplier ingredient changes and check substitute products before service.
  • Use clear kitchen procedures to minimise cross-contact during preparation, plating and delivery packing.
  • Record allergen-related customer discussions where a higher-risk request is made.

This is also a timely prompt to review whether your current restaurant insurance reflects how your business actually operates. A venue offering dine-in service, catering, delivery, alcohol service or packaged products may have different exposures from a small café with a fixed menu. If your business model has changed, working with a broker may also help identify whether your liability, stock, contents and business interruption settings still match your risk profile.

The lesson is straightforward: allergen safety is part of customer care, but it is also part of financial resilience. Strong procedures, accurate records and suitable cover can make a meaningful difference if a food-related incident turns into a formal complaint or claim.
